Dispute Resolution and Jurisdiction

The parties agree that any disputes arising from this Policy or any other agreements between them shall be resolved through a two-step Alternative Dispute Resolution (ADR) mechanism.

Mediation: If a dispute arises, the parties will attempt to resolve it amicably through mediation. If they fail to reach a resolution within thirty (30) days of one party notifying the other of the dispute, the matter shall proceed to arbitration.

Arbitration: If mediation fails, the dispute shall be referred to arbitration by a sole arbitrator appointed by the Company. The arbitrator’s decision will be binding on both parties. Each party will bear its own costs unless the arbitrator decides otherwise. The arbitration will be conducted in English, with Palitana, Gujarat, serving as the seat of arbitration.

The parties acknowledge that the terms of this ADR mechanism will survive the termination or expiration of the Policy and/or Terms.

Furthermore, the parties agree that the Terms, Policy, and any other agreements between them will be governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Palitana, Gujarat.
